Videez – Terms of Service

Welcome to Videez. These Terms of Service (“Terms”) govern your access to and use of the Videez mobile application and related services (collectively, the “Service”). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Description of the Service

Videez is an AI-powered video creation tool. The Service allows you to generate videos from text prompts, optionally using reference images you provide, templates, and related features. Outputs are produced using third-party artificial intelligence systems. Features may include account-based credits, subscriptions, video history, and optional sharing to an in-app community pool.

We may modify, suspend, or discontinue features at any time. We do not guarantee uninterrupted or error-free operation.

2. Eligibility

You must be at least 13 years old, or the age of digital consent in your jurisdiction (whichever is higher), to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf where required by law.

3. Accounts and access

The Service may use an account or device-linked identifier (for example, through Firebase) to provide credits, save jobs, and sync settings. You are responsible for activity under your account. Notify us at hexacodes.lb@gmail.com if you believe your access has been compromised.

4. Subscriptions, credits, and payments

Certain features require a paid subscription or credits. Purchases are processed through the Apple App Store, Google Play, and/or our payment partner (e.g. Adapty) under their terms and your store account settings. Prices, renewal terms, and cancellation are governed by the applicable store and in-app disclosures.

Credits and entitlements are defined in the app and may change. Unless required by law or store policy, fees are generally non-refundable once consumed or outside the store’s refund window.

5. Your content and license to us

You retain ownership of content you upload (such as images) and of prompts you submit, subject to these Terms and applicable law.

To operate the Service, you grant us a non-exclusive, worldwide, royalty-free license to host, process, transmit, and display your content solely as needed to: (a) generate videos you request; (b) provide storage and playback as part of the Service; (c) operate optional features you choose (such as the community pool); and (d) comply with law and protect the Service.

This license ends when your content is deleted from our systems, except where retention is required by law or legitimate backup/archival practices for a limited period.

You represent that you have all rights necessary to upload and use your content and that doing so does not violate anyone else’s rights.

6. AI-generated output

Outputs are generated by automated systems. They may be inaccurate, incomplete, or unsuitable for your intended use. Outputs are provided “as is” for personal and creative use unless we expressly state otherwise.

You are responsible for how you use outputs, including compliance with law, third-party rights, and platform rules when you share them. We do not warrant that outputs are non-infringing or fit for any particular purpose.

8. Community pool (if enabled)

If you choose to share a video to the community pool, you understand it may be visible to other users. You should not share content you consider private or that violates these Terms. We may remove pool content at our discretion.

9. Intellectual property

The Service, including its design, branding, software, and non-user materials, is owned by us or our licensors and protected by intellectual property laws. Except for the limited rights to use the Service under these Terms, no rights are granted to you.

“Videez” and related marks are our trademarks; you may not use them without prior written permission.

10. Third-party services

The Service relies on third parties (e.g. AI providers, cloud infrastructure, analytics, payment platforms). Their use is subject to their terms and privacy policies. We are not responsible for third-party services we do not control.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, OFFICERS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE OR CONTENT, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS (USD $50), EXCEPT WHERE LIABILITY CANNOT BE LIMITED UNDER APPLICABLE LAW.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted.

13. Indemnity

You agree to defend, indemnify, and hold harmless us and our affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms or applicable law.

14. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we need to for legal, security, or operational reasons. Provisions that by nature should survive (including licenses granted to us for processing prior to termination, disclaimers, limitations of liability, and dispute terms) will survive.

15. Governing law and disputes

These Terms are governed by the laws applicable in your primary place of residence or, where we elect and law permits, the laws of the jurisdiction where the Service operator is established—without regard to conflict-of-law rules. Courts in those jurisdictions may have exclusive jurisdiction unless mandatory consumer protections in your country require otherwise.

16. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms with a new effective date. Material changes may be communicated through the app or store listing where required. Continued use after the effective date constitutes acceptance of the updated Terms, to the extent allowed by law.
